Grandparent’s Rights in Scotland

Grandparents play a very important role in children’s lives. Despite this the current legislation in Scotland does not provide much protection to ensure the maintenance of such an important relationship.
Children usually benefit from having regular contact with grandparents and some may even be better placed residing with a grandparent. If parents are separating or there are concerns about the care of a child, grandparents can provide a safe and comforting haven for the child.
Every grandparent who has regular contact with their grandchild has a right to a “family life” with that child. It is our opinion that this extends at least to continued regular contact with the child and possibly to having the child reside with the grandparent and obtaining parental rights and responsibilities. This right is based on the European Convention on Human Rights and the related European case-law on the right to a private family life.
