Best Interests of the Child

The Home Office have a statutory duty to ensure that the best interests of children are a primary consideration in any decision that they make. The immigration rules state that if your child has resided in the UK for 7 years, then they should be given the right to reside here unless it would be “reasonable” for them to leave.

Long Residence Applications

If you have resided in the UK for a significant period of time, then it may be possible to regularise your status by making an application under the long residence provisions.
The immigration rules require that you have accrued 10 years lawful residence if you wish to make an application for Indefinite Leave to Remain. Alternatively, there is a stipulation in the rules that you can regularise your status if you have stayed in the UK for 20 years unlawfully.

These applications are notoriously difficult, so expert advice is required. Please contact our specialised team for assistance.
